General conditions of sale

1. General

These general terms and conditions of sale govern the relationship between, on the one hand, SARL MAiTRE DATTIER, whose registered office is located at 58 rue de la Fraternité 93230 Romainville, and whose Siret number is 887 953 875, operating under the name "E-Boutique de Maitre Dattier", hereinafter referred to as "the Seller", and, on the other hand, the natural or legal person who places an order remotely (by means of an "online" order, via the website www.maitredattier.com ), in their own name or on behalf of third parties, for both professional and private purposes - hereinafter referred to as "the Customer". Depending on the specific situation of the Customer (consumer or not), certain clauses of these general terms and conditions may not apply to them.
SARL MAITRE DATTIER offers customers the sale of products online under the name “Maître Dattier E-Boutique”. The Client declares that he has full legal capacity.

2. Purpose

The products are described on the website www.maitredattier.com in good faith and as accurately as possible. The Customer always has the possibility of obtaining additional information on the products presented upon simple request to the email address contact@maitredattier.com , by telephone on 01 41 50 84 93. The presentation of the products therefore does not bind the Seller and does not constitute an offer in the sense of the civil law of the term.
The photographs, diagrams, drawings or video films illustrating the products do not enter into the contractual field. If errors have been introduced, under no circumstances can the Seller be held liable.

3. Order

The products offered in the Maître Dattier E-Boutique are those appearing on the Site on the day of consultation by the Customer and within the limit of available stocks.
The Customer can learn about the different products offered by the Seller on its website www.maitredattier.com . The Customer can freely browse the different pages of the site, without being committed to an order.
The products are presented by means of an information sheet (product name, composition, photo and price) prepared with the maximum accuracy and precision in order to allow a description as faithful and complete as possible. However, given the digital presentation method of the products on the Internet, it is possible that the Customer's perception of the photographic representation of the products does not correspond exactly to the product itself.
The Customer will then select the desired products and their quantity. The products will be automatically added to the Customer's shopping cart. Ordering a product listed on the site may be accompanied by registering a customer account, by clicking on "I would like to create my customer account in one click in order to track my order". The Customer must complete a form to this effect. In addition, the Customer must provide their email address and a password of their choice that will be personal and confidential and which they will need to identify themselves later on the site. The Customer accepts that entering these two identifiers constitutes proof of their identity and indicates their consent to these general terms and conditions of sale.
At any time, the Customer may obtain a summary of the products he has selected by clicking on "View basket", correct any errors made when entering the order data, complete his product selection and order the products by clicking on "Order". The Customer may choose the payment method he wishes in accordance with the terms set out in Article 6. As soon as the Customer clicks on "Buy", they definitively validate their order: the order is registered and the sale is definitively concluded. The Customer can no longer correct any errors made when entering the order data. The contract is deemed concluded upon confirmation by e-mail and implies unconditional acceptance of these general conditions. The order confirmation includes the details of the order:

  • Total amount of the order.
  • Total amount of shipping and handling charges.
  • Customer contact details.
  • Place and date of sending the order (for information purposes),

The purchase order will be recorded in the Seller's computer records, which are themselves stored on a reliable and durable medium, and will be considered as proof of the contractual relations between the parties. It is also authentic with regard to the availability and price of the items. Automatic recording systems are considered as proof of the nature, content and date of the order. The sale will only be concluded upon confirmation of the order sent to the Customer by e-mail. The Seller shall not be bound by the Customer's order until the date of sending this written confirmation of acceptance to process the order. The Seller reserves the right to subordinate the order to other conditions, to suspend it or to refuse it, in particular if the order proves to be incomplete, if the data communicated is manifestly erroneous, in the event of non-payment of previous orders, or for any other reason at the discretion of the Seller. The information provided by the Customer when placing the order is binding on the Customer: in the event of an error in the wording of the Customer's contact details, the Seller cannot be held responsible for any inability to make the delivery. Orders are only final when they have been confirmed by payment of the order by the Customer.

4. Price

The prices of the various products are indicated in Euros (€), all taxes included. The prices are deemed net, excluding shipping costs. The Seller reserves the right to modify the prices at any time. However, the products will be invoiced in Euros based on the rates in effect at the time the order is registered, subject to availability. Placing an order implies acceptance of the price indicated for the chosen product. Shipping costs, if applicable, are specified separately when you place your order and must also be paid at the time of ordering. In the order confirmation, the total amount is the final price, expressed including all taxes and charges.

5. Customs duties

Any order placed on the site and delivered outside of France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are exclusively the responsibility of the Customer. The Seller is not required to check and inform the Customer of the applicable customs duties and taxes. To find out about them, the Seller advises the Customer to inquire with the competent authorities in their country.

6. Payment terms

The Maitre Dattier E-Boutique website is governed by French law, and the items offered on the site are all shipped from France. Invoices are issued in Euros, subject to French Value Added Tax (VAT) of 5.5% and transport costs of 20%. Any order shipped to a country of the European Union outside of France is subject to VAT in the country of shipment and according to the thresholds authorized by the European Union. The Seller accepts the following payment methods: VISA, MASTERCARD, PAYPAL. The Customer will receive confirmation of receipt of payment of the price by e-mail. Regardless of the payment method chosen, the order will only be taken into account once it has been validated. As long as an order is not validated, it remains registered but is not taken into account. The validation of the order is issued once the debit authorization has been sent by the payment verification and validation organization. It is at this time that the Seller will send a confirmation email and the Customer will be debited. The Seller reserves the right to suspend any order management in the event of refusal of authorization of payment by credit card by accredited organizations or in the event of non-payment. In this case, the Seller may consider the sale as void. The Seller guarantees the complete confidentiality of banking information, secured by the SSL protocol, which automatically checks the validity of access rights when paying by bank card and encrypts all exchanges in order to guarantee confidentiality.

7. Proof of transaction

Generally speaking, the parties accept electronic means of proof in the context of their relations (e-mail, etc.). The parties agree that the data recorded by the Seller constitutes proof of all transactions made on the site by the Customer. The data recorded by the payment system constitutes proof of financial transactions. The archiving of purchase orders and invoices is carried out on a reliable and durable medium and will be produced as proof.

8. Terms of execution

Orders are processed from Monday to Friday excluding public holidays. Packages are sent from France, within 1 to 2 working days following payment of the order, except in cases of force majeure. The Seller declines all liability for late delivery or failure to deliver in the event of force majeure or an event beyond its control, which would make the execution of the agreement impossible or more expensive in whole or in part, or in the event of the actions of third parties, such as suppliers of the parties hereto, subcontractors, agents and representatives, or in the event of failure of the Customer to respect its commitments. The following are considered to be cases of force majeure releasing the Seller from its obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of obtaining supplies. The Seller will keep the Buyer informed in a timely manner of the cases or events listed above. In any event, delivery of the products on time can only occur if the Customer is up to date with its obligations towards the Seller. In addition, the deadlines are indicated in good faith in the order or its summary and are only indicative. The deadlines do not therefore constitute in themselves an essential condition of the contract and the Seller will not be required to pay any compensation or interest in the event of a delay in the performance of its obligations. The Customer may also change the set date, in compliance with the conditions set out in the confirmation email, either on the website www.maitre dattier.com , or by contacting customer service at contact@maitredattier.com , subject to payment of any costs and modifications related to this change of date. The Seller reserves the right to entrust certain services to third parties, employees or agents acting under its responsibility, within the limits permitted by legal provisions and rules regarding approval and accreditation. Products purchased on the website www.maitredattier.com are delivered to the delivery address indicated by the Customer. The Seller cannot be held responsible for the consequences of errors made by the Customer when placing an order. The Seller may also not be held liable for non-performance of the contract concluded in the event of force majeure, disruptions, partial or total strikes, in particular of means of transport and transport services. A detailed delivery note corresponding to the order, drawn up in the name of the Customer, will be attached to the order. The return of the product is only accepted for quality reasons. If necessary, we ask you to kindly send us an email to customer service at contact@maitredattier.com, accompanying the request with photos of the product and the packaging. The return is only possible 7 working days after receipt of the package.

9. Right of Withdrawal

The 14-day right of withdrawal applies to our products. Concerning our non-perishable products quickly such as date syrup and the entire grocery range, the legal withdrawal period of article L.221-28 of the Consumer Code is respected, provided that they have not been opened.

10. Availability

Offers are proposed within the limit of product availability. In the event of unavailability after placing the order, the Seller undertakes to inform the Customer by telephone or e-mail as soon as possible. The Customer may then request cancellation of the order. The Customer will, where applicable, be reimbursed by credit to his bank account no later than thirty days after cancellation.

11. Intellectual property

All texts, comments, illustrations and images reproduced on our site are reserved under copyright and intellectual property rights. Any total or partial reproduction without the Seller's agreement is strictly prohibited. The order does not entail any transfer or concession of intellectual rights unless expressly stated.

12. Responsibilities

The products offered comply with current French and European legislation. The Seller cannot be held responsible to the extent that it has performed its services in accordance with the requirements of these regulations. The Seller may only be held liable to the Customer for its fraud or gross negligence or that of its employees or agents. The Seller assumes no liability for any indirect damages arising from these terms, loss of business, loss of profit, loss of opportunity, loss of production, loss of activities, loss of customers, damage to reputation, damage or costs, this list not being exhaustive. Any complaint must be sent in writing, without delay by e-mail to contact@maitredattier.com or by registered mail addressed to the Seller, whose address is mentioned in Article 1 of these general conditions. If it appears, within thirty days following receipt of the complaint, that the Seller has failed to meet its obligations, the latter will make a new delivery of the products that are the subject of the complaint at its own expense.

13. Transfer of ownership

Maître Dattier's E-Boutique retains full ownership of the products sold until full payment of all amounts owed by the Customer as part of his order. The transfer of ownership of a good purchased by the Customer to a third party will not be supported. Only the original Customer of this good may claim access to the clauses of these general conditions of sale.

14. Protection of privacy

In accordance with the law of 6 January 1978 relating to information technology, files and freedoms, and the provisions of European regulation 2016/679 on the protection of personal data, you are informed that the e-commerce site Maitre Dattier, as data controller, implements the processing of personal data for the following main purposes: – the execution of these General Terms and Conditions; – purchasing management; – management and monitoring of your order; – the administrative relationship of the contractual relationship, – management of commercial and promotional operations and advertising; – customer protection. 15. Enforceability of the general conditions
Any order from the Customer, as well as any deliveries made by the Seller, imply the Customer's full and unreserved acceptance of these general terms and conditions of sale, to the exclusion of all other documents, such as the Customer's own general terms and conditions, or any prospectus, catalogue, etc., which have only an indicative value. The parties expressly agree that these general conditions apply to their commercial relations, unless expressly waived between them in writing. The express waiver of one of the general or specific conditions does not imply any waiver of the application of the other general or specific clauses. The cancellation or inapplicability of one of the clauses of the general or specific conditions does not in any way affect all of the other provisions of the general or specific conditions which remain valid and applicable. The fact that the Customer has not received these general conditions in his/her mother tongue does not exempt him/her from their application. Any order for a product offered on the site requires consultation and express acceptance of these general conditions of sale, without this acceptance being conditioned by a handwritten signature on the part of the Customer. Validation of the purchase order by the Seller constitutes an electronic signature which has, between the parties, the same value as a handwritten signature and constitutes proof of the entirety of the order and the due date of the sums due in execution of said order. The Seller reserves the right to change its general terms and conditions without personally notifying the Customer and without the latter being able to claim any compensation. It is therefore up to the Customer to periodically check whether any changes have been made. It is specified that the Customer may save or print these general terms and conditions of sale, provided that they are not modified.

16. Complaint - Dispute

Complaints or disputes will always be received with attentive goodwill, good faith always being presumed in the person who takes the trouble to present the dispute. Upon receipt of the products, the customer must ensure that the delivery complies with his order. Any damage must be the subject of precise, dated and signed reservations on the delivery slip. Orders marked as "delivered" by the carrier will not be eligible for refund. After analysis and acceptance of the claim by the Maitre Dattier e-commerce site, a commercial gesture (reimbursement of shipping costs, return of the product at the expense of the Maitre Dattier e-commerce site, etc.) will be offered to the customer. In the event of a dispute, the Customer will first contact the Customer Service of the Maitre Dattier e-commerce site in order to resolve it amicably. Disputes for which the request is manifestly unfounded or abusive, or have been previously examined or are currently being examined by another mediator or by a court, or if the consumer submitted his request to the mediator more than one year after his written complaint to the Maitre Dattier e-commerce site or if the dispute does not fall within the mediator's scope of competence, or finally if the consumer does not prove that he has previously attempted to resolve his dispute directly with the Maitre Dattier e-commerce site by means of a written complaint in accordance with the terms provided, where applicable, in the contract, cannot be reviewed by the mediator.

17. Guarantees

The DLUO (best before date) of our chocolates is indicated under each box. Knowing that our boxes have a DLUO of 15 days minimum to 30 days maximum for ganaches and 45 days maximum for spreads. Also, in order to best appreciate our products, we advise you to choose the delivery date closest to your consumption date. The Maitre Dattier e-commerce site guarantees the quality and freshness of its products, provided that they are stored in a cool place (between 14 and 18°C), away from light.

18. Prohibitions

The customer must not under any circumstances resell products which are intended for their personal use or that of the person to whom their order is addressed. The photos on the site are not contractual.
